Terms and conditions
This document sets out the terms and conditions (“Conditions”) under which we sell our goods and provide our services. By purchasing from our website, you agree to be bound by these Conditions. Please read them carefully before placing an order. You may print or save a copy for your records.
1. Definitions
“Business Day” means any day other than Saturday, Sunday or public holiday when banks in Dublin are open for business.
“Event Outside Our Control” has the meaning given in clause 17.
“Goods” refers to products listed on our website that we may supply.
“Services” refers to training or other services listed on our website that we may provide.

3. Goods and Services
We offer consumer beauty products (“Goods”) and professional training courses (“Services”), as detailed on our website.
4. Training Courses (Services)
Courses are suitable for individuals aged 16 or older, unless otherwise stated. Participants under 18 must be registered by a legal guardian, who will become a party to the contract.

All courses are subject to demand. If a course cannot proceed due to insufficient numbers, you will receive a full refund or be offered a place in the next available session.
We reserve the right to change course dates, times, or content with reasonable notice if necessary.
If you wish to cancel your booking, you must do so no later than 10 days before the start date. Deposits are non-refundable and non-transferable if cancelled later than 10 days before, or in the event of a no-show.
A 50% deposit is required upon booking to secure your place. The remaining balance is due on the course date.
Bookings can be made via our website or in person at Kohana Professional Training Centre, Main Street, Ballisodare, Co. Sligo. Payments can be made by card or cash (cheques are not accepted).
Once booked, you will receive an email confirmation and a reminder text the day before your course. Failure to attend without notice results in forfeiture of the deposit.
5. Prices
Prices for Goods and Services are displayed on the order page and include VAT unless otherwise stated. Delivery costs are calculated separately and added at checkout. All prices apply within the Republic of Ireland unless specified otherwise.
6. Overseas Orders
We may accept and ship orders outside Ireland. International deliveries may be subject to customs inspections, import duties, or local taxes, which are your responsibility. We have no control over such charges. Please check with your local customs office before ordering.
7. Eligibility to Contract
To place an order, you must be at least 18 years old and legally capable of entering into a contract.
8. Payment
Payment can be made securely via Shop Pay, Google Pay (G Pay), or any major credit or debit card. Payment is charged at the time the order is placed. If there are issues with payment authorisation, we will contact you.
9. Order Process and Contract Formation
All orders are subject to acceptance and availability. You will receive a confirmation email once your order has been accepted or dispatched. This confirmation forms the contract between you and us.
If a product or service is unavailable, or an error occurs in pricing or description, we will inform you and issue a refund.
We may make minor updates to products to improve quality or comply with regulations.
10. Delivery
Orders are shipped via DPD Courier to the address provided during checkout. Delivery will occur within 30 days of confirmation unless delayed by an Event Outside Our Control.
If you choose to collect your order, please do so within 3 business days of notification during working hours (Monday–Friday, 9:30 am to 5:30 pm).
If you fail to collect or accept delivery within 14 business days, we may cancel your order and charge storage fees.
For Christmas deliveries, please refer to our website for final order dates.
11. Performance of Services
Services will be performed at the agreed location and time. If external factors prevent us from performing on time, we will notify you and reschedule or refund accordingly. Please provide accurate information, including health conditions or allergies, when requested. Failure to do so may result in cancellation.
12. Faulty Services
If services are not performed with reasonable care or skill, please inform us as soon as possible. We will re-perform or rectify the service at no additional cost. Your consumer rights under Irish law remain unaffected.
13. Risk and Ownership
Goods are at your risk once delivered. Ownership transfers to you only after full payment, including VAT and delivery, has been received.
14. Cancellations and Returns
You may cancel your order within 14 days of receiving your Goods for a full refund. To cancel, use the cancellation option on our website or contact us directly.
Returned items must be unused, unopened, and in their original packaging. You must return the Goods within 14 days of cancellation at your own cost unless we agree otherwise.
If we arrange collection, the cost may be deducted from your refund. Refunds will be processed using the same payment method.
Exceptions: You cannot cancel if products have been opened, used, or if seals have been broken for hygiene reasons.

16. Liability
We guarantee that Goods and Services will match their description, correspond to samples, be fit for purpose, and be delivered with reasonable care and skill.
We cannot exclude liability for death or injury caused by negligence, fraud, or failure to comply with legal obligations. We are not liable for business losses, indirect damages, or unforeseeable events beyond our control.
17. Events Outside Our Control
We are not responsible for delays or non-performance caused by circumstances beyond our reasonable control. We will notify you promptly and take reasonable steps to minimise impact. You may cancel your contract and receive a refund if the delay continues.
18. Personal Data
Your personal data is processed in accordance with our Privacy Notice, available at https://kohanaprofessional.ie/596-privacy-notice.
We comply with GDPR and collect only the data necessary to process your order or provide our services.
19. Third-Party Rights
No third party has any right to enforce these Conditions except for our affiliates, employees, or representatives as permitted by law.
20. Dispute Resolution
If a dispute arises, you may refer it to the EU Online Dispute Resolution (ODR) platform at http://ec.europa.eu/consumers/odr.

21. Other Important Terms
We may update prices, product details, or availability at any time without prior notice.
Contracts are concluded in English only. If any clause is deemed invalid, the remaining clauses remain enforceable.
22. Governing Law and Jurisdiction
These Conditions are governed by Irish law. If you live elsewhere in the EU, you retain the consumer protection rights of your home country. You may bring legal proceedings in Ireland or in your country of residence.
